Top Story: Court Throws Out Afenyo-Markin’s GH¢15m Defamation Suit Against Sammy Gyamfi

The Accra High Court has thrown out Minority Leader Alexander Afenyo-Markin’s GH¢15 million defamation suit against GoldBod CEO Sammy Gyamfi, describing the case as incurably defective. The lawsuit followed comments by Sammy Gyamfi, who referred to Afenyo-Markin as an “extortionist” during an appearance on JoyNews’ Newsfile in August. Afenyo-Markin sought GH¢15 million in damages and an order restraining further publication of the alleged defamatory statement. With the suit dismissed on procedural grounds, questions remain about the underlying allegations. The court’s decision did not determine whether the disputed statement was defamatory or whether the allegations were true. On Top Story with Kenneth Gyasi on Joy 99.7 FM, we examine the legal implications of the ruling and speak to lawyers about what it means for media freedom, public discourse and the reporting of allegations against public officials. Does the dismissal of the suit change the legal risks for media organisations reporting on the allegations? And what does the ruling mean for the parties involved?
