The Home Office has lost its bid to keep legal action brought by Apple against the UK Government private. In March, the Investigatory Powers Tribunal, which handles cases involving unlawful intrusion and national security matters, held a closed-door hearing.
At the time, the identities of the parties involved were not disclosed to the public.
Despite this, multiple media organizations, including the PA news agency, petitioned the tribunal to disclose the identities and hold the hearing in public.
Journalists and media representatives were not permitted to attend the hearing, and the identities remained confidential.However, in a public ruling on Monday, the tribunal judges clarified that the legal action Apple is pursuing against the Home Office relates to the power granted under the Investigatory Powers Act 2016, which allows the government to issue technical capability notices.
