The Supreme Court is set to hear the case that is challenging the procedure being used to potentially remove Chief Justice Gertrude Torkornoo from office.

The case filed by Vincent Ekow Assafuah, Member of Parliament for Old Tafo, is questioning the constitutional steps taken by President John Dramani Mahama after receiving three separate petitions seeking the Chief Justice's removal.

Assafuah has asked the apex court to declare that the Chief Justice must be given the opportunity to respond to the allegations before the President can proceed with consultations with the Council of State, as stipulated under Article 146(6) of the 1992 Constitution.

Represented by former Attorney-General Godfred Dame, the MP argues that bypassing this step violates the Chief Justice's right to a fair hearing and poses a threat to the independence of the judiciary.
