The Supreme Court will, on Wednesday, April 9, 2025, hear a case challenging the procedure by President to remove Chief Justice Gertrude Torkornoo from office.
The suit, filed by the Member of for Old Tafo, Vincent Ekow Assafuah, questions the constitutionality of the process initiated by President Mahama following the receipt of three separate petitions seeking her removal.
Through his legal representative, former Attorney General Godfred Dame, Assafuah is asking the apex court to declare that the Chief Justice must be given the opportunity to respond to the allegations made against her before the President consults the Council of State, as stipulated in Article 146(6) of the Constitution.
On March 29, 2025, President Mahama directed the Chief Justice to submit a preliminary response to the removal petitions within 10 days.
