Mr Ashiford's widow, Loise Nyambura Mwangi, has told investigators and the court that her husband had travelled to Embu for work and, on the morning of September 19, 2022, ed the disputed property intending to evict Ms Nyaga after their verbal arrangement failed to materialise.
There was also an alternative arrangement according to court filings under which Ms Nyaga was to surrender six acres to Mr Ashiford in exchange for the property she was renting from him.
The court also noted that at the time Ms Nyaga claimed to have purchased the property, it had not yet been transferred to Mr Ashiford by its legal owner Margaret Wambui Murage.
