An Accra High Court has dismissed an application by mining company, Goldfields Ghana Limited.
This was after a request to the court asking that it puts on hold a judgement which demanded that the company pays its former employee 72 months’ basic monthly salary.
Mr. Setorwofia sued the company contending that he was retired on grounds of occupational ill-health.
This was based on admissions made by Goldfields Ghana Ltd in a Response to a Request to Admit Facts and in their Statement of Defence.
The admissions included the admission of a provision in the Collective Agreement signed with the Ghana Mine Workers Union which provided for the 72 months’ basic monthly salary payment upon retirement on grounds of occupational ill-health.
Justice William Boampong who heard the request for the stay of execution ruled that no exceptional circumstances had been established by Goldfields to warrant the request.
He also awarded costs of GHS 2,000 against Goldfields.
The plaintiff, Raphael Setorwofia, was represented by Tsatsu Tsikata while Lawyer Danso Amoah appeared with Bentsi-Enchill holding the brief of Kimathi Kuenyehia.
